General Booking Conditions and Data Protection
IMPORTANT NOTICE:
Villa Carmen is NOT A HOTEL but a "SEASONAL ROOM RENTAL," meaning for stays of less than one year. By law, we cannot offer any other services beyond the common area facilities. These facilities include those found in the kitchen (fridge-freezer, two microwaves, and an induction cooktop) and the laundry room (washing machine and dryer). In "seasonal rentals," payments are not subject to VAT, and the law requires that these payments be made by bank transfer. Also, for stays longer than one month, upon arrival at Villa Carmen, the tenant must sign a private rental contract.
These General Terms and Conditions of Booking aim to describe the room reservation procedure at Villa Carmen, San Roque 78, 20009-San Sebastian, and the conditions to which such a reservation is subject. The advance payment implies full acceptance without reservation of each and every one of the general conditions described here.
BOOKING PROCESS:
The available booking dates are displayed in the occupancy calendar for each room, and prices are indicated in the table. In the calendar, red lines mark unavailable days. Based on this calendar, you can decide which room and for what dates you would like to rent. Next, you should contact us via email or phone.
Once we know the dates of your stay, we will confirm room availability, the price of the stay, the amount of the deposit or advance, and the cancellation conditions to which the reservation is subject. We will also provide you with the bank account number to which you must transfer this deposit within a maximum of THREE DAYS. ONLY THE RECEIPT OF THE DEPOSIT OR ADVANCE ENSURES THE RESERVATION OF THE ROOM. No other payment method is considered.
The amounts of deposits and advances are as follows:
a) Rentals longer than 1 month: 1-month rent deposit to reserve. Advance payment of the first month's rent upon signing the contract. Deposit refunded by bank transfer at the end of the stay, after inspecting the room.
b) Rentals less than 1 month: 1-month deposit and full rent advance to reserve. Deposit refunded by bank transfer at the end of the stay, after inspecting the room.
Payment of deposits and advances implies the tenant's acceptance of the booking conditions. Only when this payment occurs will the availability of the reserved room disappear from the occupancy calendar on the website. Immediately, the tenant will receive a CONFIRMATION OF RESERVATION email with their reservation number, which will serve as proof of the reservation.
The electronic document formalizing the reservation will be archived and may be accessible upon request. You can formalize your reservation in any of the available languages indicated on the homepage of this website.
Reservations or stays of clients under 18 years of age will not be accepted unless accompanied by an adult.
BOOKING CONDITIONS:
Prices: The total amount will appear in the "Summary of your reservation" in the confirmation email. There is no VAT on "Seasonal room rentals."
Included Services: Water, electricity, heating, and high-speed WiFi connection costs are included in the price. Two sets of bedding and towels are provided at the time of rental and must be returned. No bedding replacement or room cleaning services are provided and must be arranged by the tenant. If the tenant wishes, we can provide information about companies or individuals who provide individualized and regular cleaning services. For this purpose, please contact us. Parking for a maximum of two vehicles can be provided. The parking price depends on the stay and should be discussed with the owners.
MODIFICATION OR CANCELLATION:
Each reservation is subject to cancellation and payment conditions that must be accepted by the customer at the time of making the reservation, and are contractually binding for both parties. Please ensure you have read and accepted the cancellation and payment conditions before confirming your reservation. You can modify or cancel your reservation via email, specifying your reservation number and the email provided in the process.
CANCELLATION of the reservation will be subject to the following conditions:
a) Full refund of the deposit if cancellation is communicated one month before the rental start date. b) 50% of the deposit if cancellation is communicated less than one month and more than one week before the rental start date. c) No deposit refund if cancellation occurs less than one week before the rental start date. d) For stays less than one month, the deposit refund applies according to the above points, although the advance payment for the stay is refunded in any case.
If a RESERVATION MODIFICATION involves the cancellation of agreed-upon days, they will be subject to the same cancellation conditions described above.
TERMINATION:
The rental contract ends on the contract termination date. The deposit is returned by bank transfer to your original account after room inspection. If you wish to terminate the contract in advance, you must inform us by phone, email, or in person, with one month's notice. If not, the deposit will cover the number of days the room remains unoccupied.
DATA PROTECTION:
Finally, we would like to inform all tenants and users of the villacarmendonosti.com website and its reservation system about its Personal Data Protection Policy, in accordance with the provisions of Organic Law 15/99 of December 13.
By completing one of our forms and accepting our personal data policy, you agree to allow us to use and process the data provided for the purpose specified in the form, which may include:
